Cannot be varied by DVP — Under the Local Government Act, s. 498(2), development variance permits cannot vary use, density, residential rental tenure requirements, or flood plain specifications. Confirm the correct approval pathway if any of those apply.
Lot and parcel coverage requires extra review — Coverage may be variancable where the bylaw regulates it as a matter of siting, size, or dimensions, but not where it functions as a density control. Check the bylaw structure and wording before relying on a DVP.
Verify bylaw definitions before finalising — Averaging rules, exempted areas, and measurement methods vary by bylaw and municipality. Confirm these before the table goes into a staff report.
